What Is UP RERA and Why Does It Exist?

UP RERA — the Uttar Pradesh Real Estate Regulatory Authority — was launched on 27 October 2016, making UP one of the first states in India to implement the RERA Act. Its headquarters is in Lucknow, with a regional office in Greater Noida for NCR projects. The authority was created specifically because the real estate sector had a long history of project delays, fund misuse, and misleading advertisements — all of which left buyers with no legal recourse.

How Many RERA Registered Projects Are There in Lucknow?

How to Verify a Project on UP RERA Before Buying

Go to up-rera.in and click on "Projects" in the top menu. You can search by project name, promoter name, or registration number. Every legitimate registered project will show you:

  • The approved project layout and sanctioned map
  • Possession date the developer committed to
  • Quarterly construction progress updates
  • Escrow account details showing how collected funds are held
  • The promoter's previous project history

Since 2024, UP RERA also requires every project's marketing material — brochures, hoardings, website listings — to carry a QR code that links directly to the project's UP RERA page. If an advertisement doesn't have this QR code, or if scanning it doesn't lead to a verified UP RERA page, treat it as a red flag.

What UP RERA Actually Protects You From

Delayed possession: If a developer misses the committed possession date, they must pay you EMI compensation for every month of delay. You also have the right to exit the project entirely and claim a full refund with interest.

Fund diversion: Developers must deposit 70% of all money collected from buyers into a separate escrow account that can only be used for that specific project's construction and land costs. This prevents builders from using your flat payments to fund a different project.

Advance payment cap: No developer can ask for more than 10% of the property cost before signing the sale agreement. If a builder is demanding a large booking amount upfront without paperwork, they are violating RERA.

Structural defects: For five years after possession, the developer is legally responsible for any structural defects in your unit — at no cost to you.

Misleading advertisements: Whatever is shown in an advertisement — amenities, floor plan, view — the developer is legally bound to deliver exactly that. Any deviation gives you grounds for a complaint.

How to File a Complaint with UP RERA Lucknow

Complaints against projects located outside the NCR — which includes all of Lucknow — are handled by the Lucknow Bench of UP RERA. Here is the step-by-step process:

  1. Register on up-rera.in using your email and mobile number
  2. Log in and select "Register New Complaint (Form M)"
  3. Fill in the complaint details and upload supporting documents: sale agreement, payment receipts, allotment letter, and any written communication with the builder
  4. Pay the ₹1,000 complaint fee online through the portal
  5. Download a copy of the submitted complaint for your records
  6. Send a self-attested hard copy to the UP RERA Lucknow office

Once filed, the system automatically notifies the builder and assigns the case to the Lucknow bench. Both parties receive email and SMS updates. The builder must file a written reply on the first hearing date. In straightforward cases, the complaint is sometimes resolved on the first date itself. Typical resolution takes up to 60 days, though complex cases can take longer.

What If the Project Is Not Registered Under RERA?

This is more common than most buyers realise. If you suspect a project should be registered but isn't, you can still file a complaint on UP RERA's portal.
